Terms of Sale

1. Who you are buying from

2. Orders and acceptance

Your order is an offer to purchase. Our acceptance occurs when we email your order confirmation/receipt. We may decline or cancel an order before dispatch where a product is out of stock, where there has been an obvious pricing or description error, or where we reasonably suspect fraud - in which case we will refund any amount paid in full, promptly.

3. Prices and payment

All prices are in Australian dollars (AUD). Prices may change at any time, but changes will not affect orders already accepted. Payment is processed securely by Stripe at the time of order. We do not see or store your card details.

4. Delivery

Delivery is per our Shipping & Delivery policy, which forms part of these terms. Delivery timeframes are estimates. Risk in the products passes to you on delivery; title passes on payment.

5. Returns and remedies

Returns and refunds are per our Returns & Refunds policy, which forms part of these terms and which is subject in all respects to the Australian Consumer Law.

6. Product information, cosmetics and safety

Our products are cosmetics for external use only. They are not therapeutic goods and no statement on this website is a claim to diagnose, treat, cure or prevent any medical condition. Ingredient lists are published on each product page; if you have sensitive skin or known allergies, review the ingredients and patch test before full use (apply a small amount to the inner forearm and wait 24 hours). Discontinue use if irritation occurs. Keep out of eyes and out of reach of children. While we take care to ensure product descriptions and imagery are accurate, minor variations (for example packaging updates) may occur.

7. Website content and intellectual property

All content on this website - including the Phresh Care Co name, logos, artwork, product names, images and text - is owned by or licensed to us and protected by intellectual property laws. You may not reproduce it for commercial purposes without our written permission.

8. Liability

To the maximum extent permitted by law, and subject always to the Australian Consumer Law (including the consumer guarantees, which are not excluded or limited by anything in these terms):

(a) our total liability in connection with any order is limited to the amount you paid for that order; and

(b) we are not liable for indirect or consequential loss.

Where legislation implies a guarantee or condition that cannot be excluded but permits limitation, our liability is limited, at our option, to replacement of the products or resupply of equivalent products, or payment of the cost of doing so.

9. Events beyond our control

We are not responsible for delay or failure to perform caused by events beyond our reasonable control (including carrier failures, natural disasters, and supplier failures), though we will keep you informed and you retain all ACL rights and any right to cancel undelivered orders for a full refund.

10. General

If any part of these terms is found invalid, the rest remain in effect. These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland. We may update these terms from time to time; the version published at the time of your order applies to that order.
